New Jersey Passes Bill for Mobile Facilities

Senate No. 2996 (S 2996) was signed by New Jersey Governor Phil Murphy on November 8, 2021, and allows licensed cosmetologists and hairstylists to provide professional services by way of mobile facilities. S 2996 will take effect November 1, 2022. We anticipate the New Jersey State Board of Cosmetology and Hairstyling (Board) will draft rules regarding mobile licensing in advance of November 1, 2022.

S 2996 defines a “mobile facility” as a shop that can be moved from one place to another by a vehicle that is registered, insured, and inspected in compliance with both motor vehicle and municipal laws and regulations. A mobile facility can offer services within the definition of cosmetology and hairstyling, beauty culture, barbering, manicuring, hair braiding, and skin care specialty services.

A mobile facility must provide the Board a publicly accessibly website that displays a 14-day location schedule at least two weeks before the first scheduled client. Changes to the schedule may be made within the first seven days after posting the website—if the schedule changes after the first seven days, the Board must be notified.

A mobile facility must be outfitted with and use a vehicle tracking device to ensure its location corresponds with the 14-day location schedule. It will be unlawful for a mobile facility to provide services at a location other than the location published on the schedule for the allotted date and time.

A mobile facility cannot operate within 300 feet of a shop licensed by the Board unless the mobile facility is:

  • Affiliated with the licensed shop
  • Parked outside the home of a customer receiving services
  • Participating in an event (for example, a municipal or county function)

Mobile facilities must comply with the Americans with Disabilities Act of 1990 and display a shop sign visible to the public from the exterior.
